Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of Occam (the “Service”). By creating an account or using the Service, you agree to these Terms. If you're using Occam on behalf of an organization, you're agreeing on that organization's behalf.
The service
Occam is a fundraising platform for nonprofit organizations, including donation pages, events, auctions, memberships, a donor CRM, outreach, and reporting. Occam is under active development, and features may be added, changed, or removed as the product evolves.
Accounts and eligibility
You're responsible for the activity under your account and for keeping access to it secure. You must provide accurate information and be authorized to act for any organization you set up. You must be old enough to form a binding contract in your jurisdiction.
Acceptable use
Don't use Occam to break the law, infringe others' rights, send unsolicited or deceptive messages, upload malicious code, or attempt to access data that isn't yours. You're responsible for having the right to use the donor and constituent data you put into the Service and for using it lawfully.
Payments and donations
Donations are processed through Stripe on your organization's connected account, and are subject to Stripe's terms and processing fees. You are responsible for issuing tax receipts, honoring refunds, and meeting the charitable-solicitation and tax obligations that apply to your organization.
Your data and content
Your organization owns the data it puts into Occam. You grant us the permissions needed to host and process that data in order to provide the Service. We'll handle personal information as described in our Privacy Policy. You can export your data, and request its deletion when you stop using the Service.
Our intellectual property
Occam, including its software, design, and branding, belongs to us. These Terms don't grant you any right to our intellectual property beyond using the Service as intended.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. While Occam is in its pilot period especially, we can't guarantee it will be uninterrupted or error-free. You're responsible for keeping your own copies of important data.
Limitation of liability
To the fullest extent permitted by law, Occam won't be liable for indirect, incidental, or consequential damages, or for lost data or revenue, arising from your use of the Service.
Termination
You can stop using Occam at any time. We may suspend or terminate access if these Terms are violated or if needed to protect the Service or its users. On termination, you can request an export of your data within a reasonable period.
Changes to these terms
We may update these Terms as the product and our practices change. When we make material changes, we'll update the date below and, where appropriate, notify account holders. Continued use after changes take effect means you accept the updated Terms.
